Definitions

“The Business” means Cheshire Dream Catchers Party Co Ltd. The person who books the equipment warrants that they are either the “Hirer” or have the authority of the Hirer to book the equipment. “The equipment” means goods hired. “The Agreement” means the Hire Agreement between Cheshire Dream Catchers Party Co Ltd and the Hirer of the equipment.

Agreement

By hiring goods, products and other services from the Business, you, the Hirer will be responsible for damage during the hire period and ensure that all possible steps are taken to avoid injury or damage as well as ensure all safety instructions and guides are followed.


You will need to read these terms and conditions and, by proceeding with your booking, you are agreeing with this disclaimer. The Hirer has placed an order via the booking form and agrees to accept the conditions of the agreement. The Business will retain the hire agreement for the hire of the goods, which the Hirer, or agent of the Hirer, will be supplied a copy of upon request.

Booking and Cancellation Procedures

All bookings require a £50 deposit to secure the date and a £50 security damage deposit. The booking deposit will be taken off the balance of the event booking and the damage deposit refunded within 48 hours if there is no damage.


To secure your booking the £50 deposit needs to be paid when confirming the booking.The outstanding balance is to be paid no less than 14 days prior to your event, excluding short notice bookings (less than 14 days prior to event) where the balance is due immediately. If the balance is not paid by the due date the Business reserves the right to cancel the hire/booking and no refund of any payments will be given.


Please note all deposits are non-refundable. If, unfortunately if the event is cancelled by the Hirer, if there is an alternative date available, the Business endeavour to offer a change of event date. If, unfortunately, a guest and/or guests fail to attend your event, regardless whether notice is given or not, prior to, or on the event date, the Business is unable to offer a reduction in the balance once the deposit has been paid.


The Business reserves the right to cancel the booking at any time for any reason and will provide as much notice as possible.  In the event cancellation by the Business, the Hirer will be refunded any monies paid in respect of the booking, however the Business will not be liable to pay any compensation to the Hirer or any other person for any loss, damage or expenditure arising directly or indirectly from the cancellation. The Business reserves the right to terminate the booking without notice if there is a breach of these conditions. 


Please note, when ordering any custom-made goods, the complete party package must be paid for in full before printing. The personalisation/name (s) written on the invoice will be exactly what is printed. It is the client’s responsibility to check spellings are correct upon receiving the invoice and prior to paying the deposit. Once the deposit has been paid the Business reserves the right to refuse to reprint the items and no refunds will be given.

Receipt of Delivery

The Hirer is responsible for being present to accept the delivery of the equipment. The Hirer is responsible for any loss or damage incurred if s/he arranges equipment to be delivered without being present or without an authorised agent present. The Hirer is responsible for losses or damage resulting from equipment being delivered to an unattended premises or location as requested by the Hirer.


In the event the Hirer or a representative are not present or allow entry for collection, you the Hirer are liable for a secondary full nights hire as per your invoice. The Business will advise of the collection date prior to collection. If the Business is unable to collect due to adverse weather or road closures the Business will collect on the following day, if able to do so. It will be the Hirer’s responsibility to ensure a suitable representative is at the collection venue on the day the Business arrives. If the Hirer fails to ensure a representative is present, the Hirer will be liable for the complete invoice charge for every night the Business is unable to collect.

Use of Equipment

During the set-up and dismantling of the equipment, do not allow anyone on or in the equipment as this may cause injury. The set-up and dismantling of equipment must only be performed by an employee of the Business. The tampering of any equipment/products is strictly forbidden at any time by children. The individual teepees are not suitable for outside use and are for indoor use only.


The Hirer is responsible for indicating clearly the location of the assembly or dismantling of the equipment. The Business will take every care, but shall not be liable for any damage to the site, site access, furniture or personal belongings.


The Hirer is responsible for checking the hired items upon delivery and should contact the Business immediately to notify of any discrepancy or damage discovered. If at any time during the hire period the Hirer considers the equipment to be faulty, it is the Hirers responsibility to contact the Business by telephone to report the problem. The Business reserves the right to repair or replace the faulty equipment as soon as practicable during the hire period to the reasonable satisfaction of the Hirer. The Business will not be liable for any loss, damage or expenditure incurred by the Hirer due to faulty Equipment for any reason whatsoever.


The equipment is intended for hire use only and as such, it will not be provided in an unused condition. As it will have been previously hired, some products may have slight marks. It is your duty to inform the Business during set up if you are dissatisfied in any way before they leave the premises.This will allow the Business to fully rectify this situation in the unlikely event of dissatisfaction.


These terms and conditions are for the safety of all individuals using this equipment, and it is the sole responsibility of the Hirer to ensure they are always fully adhered to. All equipment/products are not suitable for children under 36 months. Please ensure children under this age do not use the equipment at any time. By paying your deposit, you, the Hirer, accept sole responsibility for the safety of all persons using this equipment and agree to ensure it is supervised at all times by either you, or a responsible adult, and by booking with the Business you accept full liability for any injury occurring from misuse or reckless use.

Damage

An additional cleaning charge of £25 will be applied to any equipment or bedding returned excessively dirty and/or a damaged goods invoice will be issued in the event of any loss or damage.  The Hirer will be liable to pay the invoice and accepts this fact upon proceeding with their booking and applies to all hire equipment.  Any replacements necessary will be taken out of the Hirer’s £50 deposit.


All hire equipment and bedding must be returned dry. face paint, party poppers, confetti, coloured streamers or silly string which tend to result in damage to bedding and an additional cleaning fee. No food, drinks, or chewing gum is allowed in the Teepees. Please do not smoke on or near the equipment. Keep all products/goods away from fire and candles. Climbing, hanging or sitting on the structures of the equipment must not be allowed as this may cause injury. Users must be supervised to ensure they are not behaving in a reckless manner which poses risk of injury or distress to others, or damage to equipment.


Please keep pets away from the beds.

Allergic Reactions

We, the Business, cannot be held responsible for the safe consumption, or any issues resulting from food allergies. It is your responsibility to check all food labelling and the entire contents of the , and that it is suitable and safe for the consumption of guests with intolerances and/or allergies. We, the Business, cannot be held responsible for any adverse reaction to any ingredient and/or product, either in the Spa Pamper Kits or otherwise. We recommend that you read the ingredient lists carefully before any products are used and/or applied. It is your responsibility to immediately cease the application of the product(s) if any reaction occurs. It is the responsibility of you, the Hirer, to always chaperone all staff members. All persons using products or equipment do so at their own risk.

Insurance

The Business has suitable public liability insurance and takes the highest care to ensure the safety of all party guests.  The Hirer is responsible for the security of the equipment and any lost or damaged equipment will be charged to the Hirer at full replacement value.

Liability to Third Parties

The Business will not be liable for any claim for personal injury, death, loss or damage to the property however caused unless it is proved that such injury was caused by faulty material, workmanship or negligence on the part of the Business. The Businesses decision is final in all matters relating to these Terms and Conditions of Hire. No information included in this booking form will be disclosed to any third party.
